3.1 What We Guarantee. Flowmation guarantees that the system we build for you will perform the following specific functions ("the Guaranteed Functions"): automatically respond to each qualifying inbound lead received through the communication channels we integrate for you, with a personalized reply, in under sixty (60) seconds, on a 24/7 basis. Response time is measured from the moment a qualifying lead is received by the system to the moment the system dispatches the response.
3.2 What This Guarantee Is Not. This is a guarantee of system capability, not of business outcomes. We do not guarantee, and this policy does not cover, any level of lead volume, appointments, showings, sales, commissions, revenue, or any other business result. Those depend on factors outside our control, including your market, your lead sources, and your own follow-through.
3.3 The Guarantee Window. The guarantee applies for thirty (30) calendar days beginning on your Go-Live Date — the date the completed system is activated and running in your environment, as confirmed in writing by Flowmation at handover.
3.4 How to Invoke It. If, during the Guarantee Window, the system is not performing the Guaranteed Functions as defined in 3.1, you must notify Flowmation in writing (email is sufficient) and describe the specific failure. This begins the cure process.
3.5 Our Right to Cure. Upon receiving your written notice, Flowmation has ten (10) business days to resolve the reported issue so that the system performs the Guaranteed Functions. If we resolve it within that period, the guarantee is satisfied and no refund is owed.
3.6 Refund. If Flowmation cannot make the system perform the Guaranteed Functions within the ten (10) business-day cure period, you are entitled to a full refund of the one-time build fee paid for that system, including any deposit. This refund right applies only to a capability failure of the delivered, live system reported during the Guarantee Window, and it is the sole and complete remedy under this guarantee.
3.7 Exclusions. No refund is owed, and the guarantee does not apply, where a failure results from: (a) your failure to provide, or your revocation of, the access, accounts, or credentials the system requires to operate; (b) changes you or a third party make to your connected tools, accounts, or workflows after Go-Live; (c) outages, suspensions, policy changes, or failures of third-party services the system relies on (for example, email, calendar, CRM, or messaging providers) that are outside Flowmation's reasonable control; (d) your request to pause, disable, or materially modify the system; or (e) any failure you did not report in writing within the Guarantee Window.
3.8 The Monthly Retainer Is Separate. The monthly retainer is billed monthly for ongoing monitoring, maintenance, and the services described in your plan. It is not part of the one-time build fee and is not covered by this guarantee. You may cancel the retainer at any time with thirty (30) days' written notice; the final month is prorated to the cancellation date. Retainer fees already paid for services rendered are non-refundable.
3.9 Cancellation Before Go-Live. The guarantee and its refund right (3.1–3.7) apply only on and after your Go-Live Date. Before Go-Live: if you submit a written cancellation request before any build work has commenced, your deposit is refunded in full; once build work has commenced, the deposit is non-refundable, as it covers work already performed and build capacity reserved. In short: the deposit protects the build; the guarantee protects the result.
